By installing or using Windows 11 Folder Color Changer (“the Software”), you agree to the terms outlined in this End User License Agreement (“the Agreement”).
If you do not agree, refrain from using the Software. If the Software is already installed, uninstall the Software.
GRANT OF LICENSE
Freeware: For the purposes of this Agreement, the Freeware version of the Software refers to any copy of the Software for which you have not paid a license fee directly to the Software Vendor and obtained a product key; or which you have not unlocked using a product key after paying a license fee directly to the Software Vendor and obtaining a product key. The Freeware version is feature-limited and does not include any support. While you can use the Freeware version at no cost, access to all features or limited end-user support requires payment of the applicable license fee.
Fully Licensed: For the purposes of this Agreement, a Fully Licensed version of the Software is any copy of the Software for which you have paid a license fee directly to the Software Vendor and obtained a product key; or which you have unlocked using a product key after paying a license fee directly to the Software Vendor and obtaining a product key. To fully license the Software, click the “Unlock more features!” button on the main window and follow the instructions. Visit https://beta.foldercolorchanger.com/ for additional information. By paying the license fee, you gain access to all features and limited end-user support from the Software Vendor.
Concurrent installs of a fully licensed version: You are allowed up to five (5) concurrent installs of a fully licensed version using the product key. After exhausting this limit, you may need to purchase another product key. Notwithstanding the foregoing, the Software Vendor allows for one (1) installation per year using the product key as of the anniversary of the date the product key was first issued.
DISTRIBUTION OF ORIGINAL INSTALLER (SETUP FILE)
You are free to distribute exact copies of the original, unmodified installer for the Software. Charging for the Software is prohibited. You must include a copy of this Agreement or a clearly visible link to this Agreement on https://beta.foldercolorchanger.com/ with the installer. You may not remove or alter any identification, proprietary notice, label, or trademarks on or in the Software.
ALL RIGHTS RESERVED
All rights in the Software not expressly granted are entirely and exclusively reserved by the Software Vendor.
RESTRICTIONS
The digital information in the Software is confidential and proprietary to the Software Vendor. The Software Vendor retains title to all copyright, patent, trademark, trade secrets, and other proprietary rights in or related to the Software.
MODIFICATION AND TECHNICAL PROTOCOLS
You may not modify the Software in any manner. Decompiling, disassembling, or attempting to access the source code is prohibited, except where allowed by applicable law.
The Software contains technical protocols and restrictions designed to support the licensing process and prevent unauthorized use. These protocols require the Software to connect to the Software Vendor’s server.
You are prohibited from attempting to bypass these technical restrictions or interfere with the connection between the Software and the Software Vendor’s server.
INTERNET ACCESS REQUIRED & LICENSE VALIDATION
The Software requires internet access to validate your license every fourteen (14) days. If the Software is blocked from accessing the internet (including by firewall or other means), it will revert to the freeware version until it can validate your license.
You may not intentionally prevent the Software from validating your license.
The Software does not transmit any personal information or any data from your computer to the Software Vendor’s server.
RIGHT TO REVOKE LICENSE
The Software Vendor reserves the right to temporarily or permanently revoke your license, including blocking your product key, if there is suspicion, detection through licensing protocols, or awareness of unlawful use of the Software. This includes attempts to bypass technical restrictions or share your product key outside your household. If you contest this action, the burden of proof lies with you.
NO ABSOLUTE RIGHT TO INSTALL OR USE THE SOFTWARE
You do not have an absolute right to install or use the Software, except as described herein.
TERM OF LICENSE
This license is effective until Windows 11 stops supporting the Software, the Software Vendor ceases support for the Software, or the license is otherwise revoked by the Software Vendor. Failure to comply with this Agreement or unauthorized use of the Software terminates the license automatically.
UPGRADES, MAINTENANCE, AND SUPPORT
The Software Vendor is not obligated to provide upgrades, maintenance, or specific support. Limited end-user support may be provided to fully licensed users. The Software Vendor reserves the right to modify or revoke support for the Software at any time.
The Software Vendor does not provide support for Freeware versions of the Software.
For support, e-mail support@delitech.co.za during business hours (Monday to Friday, 10 am to 6 pm, GMT+2). Support requests must come from the e-mail address used to license the Software for verification. Allow up to 24 hours for a response.
REMOTE SUPPORT
In the event that you claim the Software is not working as expected or is otherwise defective, our Support Team may request your consent and assistance to connect to your computer via AnyDesk or a similar remote support tool to help diagnose or otherwise troubleshoot the issue.
IF YOU DO NOT CONSENT TO REMOTE SUPPORT
If you do not consent to remote support, our Support Team may be unable to diagnose or troubleshoot your issue effectively. Any support and guidance provided may be general and might not address your specific situation. In such cases, you are responsible for troubleshooting the issue yourself and providing our Support Team with as much technical information as possible. Any obvious defects or failures of the Software should be apparent in the freeware version before you purchase a license. Therefore, you will not be entitled to a refund of the license fee.
IF YOU CONSENT TO REMOTE SUPPORT
If you consent to remote support, our Support Team will guide you through connecting to your computer via AnyDesk or a similar remote support tool. During this connection, our team will run the app, open the app folder in %appdata%, and review the app settings. They may create test folders within the app folder or other locations you specify and view the corresponding desktop.ini files. Our Support Team may use the remote support tool’s built-in chat feature to obtain more information or your consent for specific technical steps.
Our Support Team may review your system configuration, startup items, installed apps (to check for conflicts), shell entries, and security settings. They may restart Windows Explorer and perform other technical steps to troubleshoot the issue. During this process, our team may “see” glimpses of your apps, desktop, start menu, and some personal files or folders. However, they will not open any of your apps, personal files, or folders. We respect your privacy, and everything seen during a remote connection will be treated as “personal information” under our Privacy Policy.
Our Support Team operates in a secure environment with strict privacy and security protocols to ensure the integrity of all support operations. Depending on the issue, they may escalate it to our Dev Team for a fix (typically a “patch”) until an official update to the Software can be made available. Our Support Team will provide a timeline for this process. If we are unable to resolve the issue, we will refund the license fee.
LIMITED WARRANTY AND REMEDIES
The Software is provided “as is” without any warranty, either expressed or implied. Delitech (Pty) Ltd. disclaims any liability for infringement of third-party intellectual property rights. In no event will Delitech (Pty) Ltd. or its licensors be liable for consequential damages. Delitech (Pty) Ltd.’s liability is limited to U.S. $1.00.
Some states do not allow the limitation or exclusion of incidental or consequential damages, so these limitations may not apply to you.
GENERAL
You agree to obtain any necessary export license before exporting the Software, complying with your country’s export control laws.
This Agreement is governed by the laws of the Republic of South Africa. You agree to the exclusive jurisdiction of South African courts for dispute resolution. The prevailing party in any legal action is entitled to reimbursement for expenses, including court costs and attorneys’ fees.
By using the Software, you acknowledge reading, understanding, and agreeing to this Agreement, considering it the complete and exclusive statement governing the subject matter, superseding any prior agreements or communications between you and Delitech (Pty) Ltd.
